R159 I'm thinking Uncle Don probably wouldn't want to revisit this. .. At the sentencing portion of Teo's trial, the judge wanted to know what the feds were doing about HIM. (Burns was in the courtroom at the time.) The judge had previously mentioned "the victim's" criminal conduct, but then there was this very funny exchange later on. It's like something you'd see on TV between a testy judge and an ill-prepared government attorney .. lol!:
MS. JAIMEZ: (continuing) ... As the Court has already acknowledged and saw in trial, the victim has suffered substantial psychological harm as a result of these proceedings and as a result of the defendant's conduct, both --
THE COURT: Is there an investigation pending over the conduct of the victim?
MS. JAIMEZ: Your Honor, the government has no information about a pending investigation at this time.
THE COURT: Well, is the government undertaking any such investigation?
MS. JAIMEZ: Your Honor, I have no information about any investigation at this time.
THE COURT: What do you mean you don't have any information? You're the government. You're representing the government.
MS. JAIMEZ: Yes, Your Honor. However, the government does not have any information with respect to any open or potential pending investigations with respect to the victim. And even if there were any, Your Honor --
THE COURT: So that means there is none.
MS. JAIMEZ: Your Honor, I am not apprised of any, Your Honor.
THE COURT: Well, if you're not, who would be?
MS. JAIMEZ: At this time, Your Honor, even if there were a pending investigation, it would not be something that would be appropriate for discussion in open court at this time.
THE COURT: Well, you may not think so. ... Go ahead.
